In a surprising turn of events, Titan Farms, the largest peach grower on the East Coast, has been found in violation of labor laws that has left over 1,300 seasonal foreign workers scratching their heads in confusion. It seems the farm has been making unlawful deductions from the wages of these workers, who are part of the H-2A program.
According to an investigation by the U.S. Department of Labor (DOL), Titan Farms reportedly deducted funds from workers’ paychecks for political contributions and cleaning fees. This unlawful action resulted in the workers receiving less than the legally mandated rate of $11.13 per hour. And that’s not just a small oversight—it’s a significant violation of their rights as workers.
As a consequence of these violations, Titan Farms has been ordered to cough up a whopping $338,446 in unpaid wages to 1,341 affected workers. Out of this amount, over $200,000 has already made its way into the pockets of about half of the affected workers, which is a welcome relief for many. However, that still leaves 617 workers who are waiting for their share, collectively owed $132,308.
The DOL is taking matters into their own hands by asking the public for assistance in locating the remaining workers who have not yet received their due wages. This public outreach aims to ensure that everyone affected can reclaim what is rightfully theirs. Workers with questions or those seeking their missing wages are encouraged to check the DOL’s online database or get in touch with the agency’s helpline.
As if the wage deductions weren’t enough, the investigation also uncovered troubling safety violations within Titan Farms. It was revealed that the company allowed unsafe travel practices, putting migrant workers at risk by letting them travel in vehicles that had broken windows and worn-out tires. Such lapses in safety are alarming, especially for individuals who are already facing challenges as seasonal workers. Due to these additional infractions, Titan Farms was slapped with a fine of $2,850 for the unsafe conditions regarding employee transportation.
In response to the investigation, Titan Farms asserts that no worker was ever mandated to make political contributions or have wages deducted for that purpose. They claim that the allegations concerning political deductions have been dismissed by the DOL, contributing to a sense of controversy surrounding the situation. Interestingly, Titan Farms has participated in the H-2A program for an impressive 26 years and boasts a worker return rate of over 90%, which adds another layer to the unfolding story.
